उच्च शिक्षा के लिए सर्वोच्च समन्वय समिति गठित

संसदीय कानून के जारी उच्च शिक्षा के क्षेत्र की तमाम शाखाओं के लिए एकल नियामकीय निकाय बनाने की कोशिशे सर्वसम्मति न बन पाने के चलते खारिज होने के बाद केन्द्रीय मानव संसाधन विकास विभाग मंत्रालय ने प्रशासनिक आदेश के जारी एक सर्वनियामक संस्था का गठन किया है | गौरतलब है की इस उच्च शिक्षा सर्वोच्च समन्वय समिति ( एच ई ए सी सी ) के गठन का उद्देश्य सभी नियामकीय संस्थाओं व प्रोफेशनल कौंसिल के भिन्न –भिन्न और कभी – कभी टकराव पैदा करने वाले नियामकीय प्रावधानों के चलते पैदा  वाले मसालों का हल तलाशने के लिए किया गया है | एच ई ए सी सी की स्थिति इससे पहले लाए जा रहे “ राष्ट्रीय उच्च शिक्षा एवं शोध परिषद् (एन सी एच ई आर ) के विपरीत होगी | एन सी एच ई आर को विश्वविद्यालय अनुदान आयोग (यु जी सी ) या आल इंडिया कौंसिल फार टेक्नीकल एजुकेशन (ए आई सी टी ई ) या नेह्स्नल कौंसिल फार टीचर एजुकेशन (एन सी टी ई ) की जगह , एक सुपर रेगुलेटर के रूप में लाने का प्रस्ताव था | प्रशासनिक आदेश में स्पष्ट किया गया है की एच ई ए सी सी से प्राधिकरणों, वैधानिक नियामकीय निकायों व प्रोफेशनल कौंसिल की स्थिति को कोई नुकसान नहीं पहुचेगा | छ: सदस्यों वाली इस संस्था की अध्यक्षा मानव संसाधन विकास मंत्री करेंगे | इसमे यु जी सी व ए आई सी टी ई के अध्यक्ष के अलावा आर्किटेक्चर कौंसिल के अध्यक्ष भी शामिल होंगे | इससे पहले एन सी एच ई आर के गठन के लिए संसद में उच्च शिक्षा एवं शोध इल लाया गया था | बिल को लेकर संसदीय समिति के अलावा स्वास्थ्य मंत्रालय और बार कौंसिल आफ इंडिया ने भी चिंता जताई थी |

Case Study on Women’s Domestic Violence Act

Smt. Nirmala Sahu w/o Satyanarayana Sahu She was tortured mentally, physically, and financially by her husband after month of her marriage. After facing lots of problem and having lots of struggle, she decided to stay with her parents but she was humiliating by her society. And she and her entire parents were expelled by her community due to her unsocial situation

           She was depressed after shameful justice and humiliating by the people of her society. She decided to live along with her Sister-In-low who is living in Hirri village where there the member of Sakhi Sahkari Samiti, MSKPP also lved. She was intimating all incidences to Mrs. Hemlata Sahu organizer of Sakhi Sahkari Samiti.


Then Organization take initiative and case file in Kutumb Court under Women’s Domestic Violence Act -2005. And finally after a few months Victim got justice and by article no 125. And the judiciary asked her husband to fulfill the basic need and gave notice to provide Rs.3000/- per month for the family maintenance. At present Nirmala is surviving her life with a positive hope with dignity and also working in Sakhi sahkari samiti and focus on her better & bright future.

Reduced space of civil action

Khitij is an organization which primarily works with primitive tribes, now referred as Particularly Vulnerable Tribal Groups (PVTG). The organization’s main areas of intervention are land & forest rights, PRI strengthening and food security, with PVTGs as the core target group. In 2010 PRI election, as a part of engaging tribals in mainstream governance system, Khitij had promoted candidates in 76 GPs of Bilaspur & Korba districts to contest for various position of PRI. As part of the initiative, Ram Sai Dhanuar was contesting for the post of Sarpanch in Lengi GP, Podi Uprora block, Korba.

A local ex-MLA supported candidate had also filed for nomination from the same seat in the Panchayat. Ram Sai was receiving threats from the ex-MLA group to withdraw his nomination. But Ram Sai did not succumb to the threatening and contested the election. In the election, Ram Sai was defeated by a very marginal vote. But the defiance that he had shown to the ex-MLA diktat had infuriated them. Immediately after the election results, ex-MLA goons attacked Ram Sai and brutally thrashed him for his defiance. Ram Sai tried to lodge an FIR with the police station but the police declined to register his complain. Mr. Gyanadhar Shastri then personally approached the police station and after much persuasion, an FIR was lodged. Though the FIR was lodged, no action against the ex-MLA & his goons were initiated and case lingered for almost one year. After one year, the ex-MLA through his influence & connections framed a case over Ram Sai. Under the influence of the ex-MLA, a case of eve-teasing was registered against Ram Sai and he was arrested & sent to Jail.

The arrest of Ram Sai overturned the whole situation and the struggle of seeking justice got derailed. Mr. Shastri had to run from pillar to post to secure bail for Ram Sai. He was able secure bail in December 2011. Mr. Shastri submits that instead of fighting for the injustice that Ram Sai faced for contesting Panchayat election, they are now trying to save him from the false case of eve-teasing.

Women’s got their Justice through Collective effort

The villagers of Belganna village of the block Kota, Dist – Bilaspur were struggled for five year for their land rights from forest department of the respective area. After taking cruel action by the department they filed charge sheet against forest right act article no- 33(1) c on date 23/07/2007, culpability was to destroy 08 hr. forest plant rang no. 1110 and illegally encroachment on it. Around 26 tribal women were suspected to destroy 4000 bamboos plants. All Tribal women arrested and send to jail by forest department as P.O.R no 4015/18. Manipulation like false signature Manihar, Dashrat and Ramcharan has taken by the concern department to blame them as victims who were live as residential of that village. 

(Approval Letter of the Collector) All the villagers decided to fight for their Rights in a collective approach.  LSM and its active member Mr. Shastri was facilitated them with legal support. They all were got justice after facing lots of trouble & struggle for five years, due to lack of evidence. Now all family claims for individual land right and claim under FRA-2008.
